Definitions
In order to strengthen the regulation of tourism activities, protect the legitimate rights and interests of tourists, safeguard tourism order, and promote the healthy development of tourism, this Law is hereby enacted.
In this Law, the following terms shall have the following meanings:
(1) Tourism refers to the activities of tourists traveling to other places for sightseeing, leisure, vacation, visiting relatives, or friends, or engaging in other activities not for the purpose of work;
(2) Tourist refers to a person who engages in tourism activities;
(3) Tourism operator refers to an entity or individual that provides tourism products or services to tourists;
(4) Tourism product refers to a combination of services provided by tourism operators to meet the needs of tourists, including tour products, accommodation products, catering products, transportation products, shopping products, and entertainment products;
(5) Tourism service refers to the services provided by tourism operators to meet the needs of tourists, including travel agency services, accommodation services, catering services, transportation services, shopping services, and entertainment services;
(6) Travel agency refers to an entity that provides travel agency services;
(7) Accommodation facility refers to an entity that provides accommodations services;
(8) Catering facility refers to an entity that provides catering services;
(9) Transportation facility refers to an entity that provides passenger transportation services;
(10) Shopping venue refers to an entity that provides shopping services;
(11) Entertainment venue refers to an entity that provides entertainment services;
(12) Tourism information refers to information related to tourism, including tourism resources, tourism products, tourism services, and tourism policies and regulations;
(13) Tourism market refers to the place where tourism products and services are traded;
(14) Tourism administration department refers to the tourism administrative department of the State Council and the tourism administrative departments of local people's governments at or above the county level.


Rights and Obligations of Tourists
Article 4
Tourists shall enjoy the following rights:
(1) The right to obtain accurate tourism information;
(2) The right to choose tourism products and services according to their own needs;
(3) The right to fair and equitable treatment;
(4) The right to complain about and report tourism operators that violate laws and regulations;
(5) The right to seek compensation for losses caused by the violation of their legitimate rights and interests by tourism operators;
(6) Other rights stipulated by laws and regulations.
Article 5
Tourists shall fulfill the following obligations:
(1) Abiding by laws and regulations and respecting social customs;
(2) Protecting the environment and natural resources;
(3) Maintaining public order and respecting local customs;
(4) Paying for tourism products and services according to the agreed-upon prices;
(5) Other obligations stipulated by laws and regulations.


Obligations of Tourism Operators
Article 6
Tourism operators shall fulfill the following obligations:
(1) Providing accurate tourism information;
(2) Providing safe and quality tourism products and services;
(3) Protecting the legitimate rights and interests of tourists;
(4) Handling complaints and reports from tourists in a timely and appropriate manner;
(5) Complying with laws and regulations and cooperating with tourism administration departments;
(6) Other obligations stipulated by laws and regulations.
Article 7
Tourism operators shall not engage in the following acts:
(1) Providing false or misleading tourism information;
(2) Concealing important information related to tourism products and services;
(3) Endangering the safety of tourists;
(4) Infringing upon the legitimate rights and interests of tourists;
(5) Conducting unfair competition;
(6) Other acts prohibited by laws and regulations.


Supervision and Management of Tourism Activities
Article 8
Tourism administration departments at all levels shall be responsible for supervising and managing tourism activities within their administrative regions, and shall perform the following functions:
(1) Formulating and implementing tourism development plans;
